Family Members to Attend Key Preliminary Hearing in Charlie Kirk Murder Case

The family of slain conservative activist Charlie Kirk will attend a pivotal preliminary hearing beginning next week, marking the first time his parents and widow will sit in the courtroom with the man accused of killing him. Charlie Kirk’s widow, Erika Kirk, along with his parents Robert and Kathryn Kirk, are expected to be present throughout the weeklong hearing scheduled to begin July 6 in Utah.

The hearing represents a significant turning point in the case against Tyler Robinson, the 23-year-old from southwestern Utah who is charged with aggravated murder in Kirk’s death on September 10, 2025. During the proceeding, which is expected to extend through July 10, prosecutors will present evidence to demonstrate they have sufficient grounds to proceed to trial. Prosecutors have indicated their intention to seek the death penalty if Robinson is convicted.

Kirk, 31, was fatally shot in the neck while addressing a crowd of thousands at an outdoor event at Utah Valley University in Orem during a Turning Point USA debate. Turning Point USA is the conservative youth organization Kirk co-founded and led. A sniper positioned approximately 142 yards away fired a single bullet that struck Kirk during the event. He was transported to a local hospital where he was pronounced dead. Robinson surrendered to authorities the following day.

The preliminary hearing will mark the most significant presentation of evidence in the case to date and will feature testimony and exhibits that prosecutors plan to introduce. According to court documents, prosecutors intend to present forensic analyses, surveillance video, recordings of witness statements, autopsy findings and alleged messages from Robinson admitting to the crime.

Authorities have said DNA consistent with Robinson’s was found on the trigger of the rifle used to kill Kirk, the fired cartridge casing, two unfired cartridges and a towel used to wrap the rifle. Prosecutors also have stated that Robinson left a note for his romantic partner that read, “I had the opportunity to take out Charlie Kirk and I’m going to take it.”

A Utah judge previously denied a defense request to restrict public and media access to the proceedings. Judge Tony Graf ruled that the public and media enjoy a presumptive right to attend court proceedings, and the defense had not demonstrated that public presentation of evidence would deny Robinson a fair trial.

The case has also drawn judicial scrutiny regarding prosecutorial conduct. A judge recently found a prosecutor in civil contempt for comments made to media outlets about the strength of the prosecution’s case. Deputy Utah County Attorney Christopher Ballard spoke to media outlets, including claims that prosecutors had “ample evidence to demonstrate beyond a reasonable doubt that Tyler Robinson committed this murder.” However, Judge Graf did not remove the death penalty as a potential punishment, ruling instead that the issue could be addressed through expanded jury questioning and selection procedures.

The case has attracted extraordinary media attention and generated widespread online speculation and conspiracy theories. Initial inconclusive ballistics testing regarding whether a bullet fragment could be definitively matched to the suspected murder weapon fueled unfounded theories about potential second shooters or that Kirk’s death was staged. Both prosecutors and Kirk’s widow have argued that keeping proceedings transparent and public is the best way to counter misinformation.

Kirk was credited with mobilizing young voters to support Trump in the 2024 election and was appointed to the U.S. Air Force Academy Board of Visitors in March 2025.
