KJ Biermann’s attorney is pushing back against prosecutors’ characterization of the 15-year-old’s prior juvenile record.

Jason Sheffield, the lawyer for Kroy “KJ” Biermann Jr., issued a statement Friday after a Fulton County Superior Court bond hearing revealed previously unreported allegations involving videos on the teen’s phone. “The characterizations made in court regarding the prior juvenile matter involving KJ Biermann grossly misrepresent both the facts and the ultimate resolution of that case,” Sheffield said in the statement.

“The matter arose from inappropriate, crude behavior involving two middle-schoolers,” Sheffield continued. “It did not result in an adjudication for statutory rape, sexual intercourse, or any comparable offense.”

Sheffield added, “Any suggestion otherwise is inaccurate and creates a materially misleading impression of how the juvenile matter was ultimately resolved.”

The statement came after Deputy District Attorney Caitlin McGillicuddy made explosive claims during KJ’s bond hearing earlier Friday. McGillicuddy told Judge Melynee Leftridge that investigators had discovered videos on KJ’s cell phone allegedly showing multiple encounters of penetrative sex with a family member under the age of 12. The prosecutor claimed the videos also captured KJ using “predatory, derogatory” language toward the victim.

McGillicuddy revealed that KJ had been under court supervision since October 2025 following the alleged incident with the family member, which was reported in April 2023. She also disclosed that KJ was previously charged with sexual battery of a victim under 16, information that had not been publicly known until the hearing.

“This would now mark the second time he has been charged with an offense of a sexual nature of a very serious kind which involves female victims,” McGillicuddy noted in court.

Despite the prosecutor’s objections, KJ was granted bond Friday. He has been held at Atlanta’s Metro Regional Youth Detention Center since his Aug. 17 arrest on charges of aggravated sodomy and aggravated battery. The arrest stemmed from allegations that he assaulted a female classmate in the co-ed sauna at a Life Time fitness center in Alpharetta, Georgia, on April 23. The alleged victim, who described herself as the “best friend” of KJ’s girlfriend, was examined the following day at North Fulton hospital, where police reports found no evidence of male DNA.

The teen was officially indicted Sept. 3 on seven charges: aggravated child molestation, aggravated sodomy, aggravated sexual battery, three counts of aggravated sexual battery against a child under 16, and false imprisonment.

In his bond filing, Sheffield had requested KJ’s transfer to juvenile court and emphasized the teen’s background. “The accused turned 15 years old in May. He is a high school student in good standing who has demonstrated strong academic achievement and regularly participates in extracurricular and community-based activities,” the lawyer wrote. Sheffield also cited KJ’s football achievements and scholarship offers, and told the judge that “Real Housewives of Atlanta” alum Kim Zolciak, 47, would monitor her son since she is at home and not currently employed.

“This has been so traumatizing to [KJ] personally. He is not a boisterous kid. He is somewhat quiet,” Sheffield told Judge Leftridge during the hearing, requesting bond be set at $65,000.

McGillicuddy pushed for $190,000 bond, noting the April incident’s victim had “documented physical injury.” A statement from that alleged victim was read aloud in court. “The thought of him being released scares me more than I can put into words,” she wrote, adding she had been “living in fear” over alleged threats that KJ would come after her and her family if released.

KJ remained emotionless throughout the proceedings, supported in court by his father, retired NFL player Kroy Biermann, who sat separately from Zolciak and her eldest daughter, Brielle Biermann, in the gallery. Zolciak appeared stone-faced and had previously defended her son in an Aug. 21 statement, calling the allegations “reckless” and “deeply troubling.” Sheffield had also told reporters after the arrest that the teen was “100% innocent.”

KJ’s next court appearance is scheduled for Fulton County Superior Court.
