Selma Blair Was Off Medication and Severely Confused During Midair Meltdown, Lawyer Says

Selma Blair’s attorney says her midair outburst was not intentional.

Shawn Barnes, representing the “Cruel Intentions” actress, entered Queens Criminal Court on Monday evening alongside his client, who was arraigned on two assault charges stemming from the Sunday night disturbance aboard a Delta flight bound for JFK. Barnes, 47, immediately moved to frame the incident as a medical episode rather than a deliberate attack.

“This was not an intentional assault,” Barnes said at the arraignment, addressing allegations that Blair had slugged one flight attendant and bitten another during the chaos.

The defense attorney laid out a cascade of contributing factors that he said left Blair in a compromised state. “Ms. Blair missed several doses of… A powerful medication that controls severe neurological symptoms,” Barnes said, noting his client’s diagnoses of multiple sclerosis and Parkinson’s disease. He added that Blair had boarded the Los Angeles flight after “being on set and working extensive hours and exhaustive hours in the days leading up to this flight.”

The physical toll extended beyond exhaustion and missed medication. “Additionally, at one point, during the flight, there was an incident where Miss Blair actually fell and hit her head,” Barnes continued. He tied these elements together in his central argument: “These factors, coupled with the altitude, resulted in a state of severe confusion and disorientation.”

The episode aboard the Delta aircraft escalated dramatically after landing. Authorities allege that Blair repeatedly kicked a police officer in the head and attacked a nurse while being transported to a hospital following the outburst. The nurse became the subject of a protective order issued by Judge Indira Kahn during Monday’s hearing, with Blair ordered to stay away from the medical worker she allegedly forcefully kicked in the chest after breaking free of restraints en route to Jamaica Hospital.

Kahn set bail at $20,000 cash or $60,000 bond. Blair posted the cash amount and left the courthouse without speaking to gathered media, reportedly limping as she departed.

The state charges carry significant weight. If convicted on both counts, Blair faces two to seven years in prison. But the legal exposure does not end there. Sources indicated the actress is also set to face at least one federal violation for “assault committed within special maritime and territorial jurisdiction of the United States,” a designation that applies to crimes aboard aircraft in flight.

Blair’s career spans prominent roles in “Legally Blonde” and “Hellboy” alongside her breakout performance in “Cruel Intentions.” The Monday court appearance marked her first public facing of the charges that have drawn intense scrutiny to both her medical conditions and the circumstances of the flight.

The restraints that failed to hold Blair during the hospital transport, her alleged biting and punching of crew members, and the subsequent kicking of law enforcement all formed part of the prosecution’s presentation. Barnes’s defense strategy hinges on establishing that none of this conduct was willful, but rather the product of a perfect storm of dehydration, exhaustion, neurological impairment, head trauma, and cabin pressure effects on a patient already missing critical doses of medication.

Blair is slated to return to court on Jan. 19.
