Halle Berry’s restraining order is extended as her court battle drags on

Olivier Martinez’s temporary restraining order against Halle Berry has been extended through the weekend as their custody battle stretches into a second week.

Berry, 60, and Martinez, 60, returned to Stanley Mosk Courthouse in Los Angeles on Friday for the fifth day of hearings focused on allegations that the Oscar winner abused their 13-year-old son, Maceo. The proceedings have been conducted largely behind closed doors, with both parties and their partners giving private testimony.

Martinez continued his closed-door testimony from Thursday, where he reportedly doubled down on claims that Berry had abused him. During cross-examination, Berry’s attorney Marina Beck confronted him with a 2024 sworn statement in which he declared the former couple had no history of domestic violence.

Beck presented Martinez with the declaration he signed under penalty of perjury on September 30, 2024. When asked whether that statement was true when he made it, Martinez replied, “correct.”

Patrick Baghdaserians, Martinez’s lawyer, later clarified that the 2024 declaration was filed in connection with a financial request. “There was no conviction of domestic violence at the time so his statement is correct,” he explained. “At the time there was no restraining order ever requested, ever entered.”

He continued, “So the statement, it’s correct. There is no history of domestic violence restraining orders. But again, that is not for anything related to custody, it’s for need-based attorneys fees.”

Berry’s fiancé, Van Hunt, 56, took the stand after a lunch break Friday. His testimony was also held in private. Hunt appeared relieved as he exited the courtroom alone around 4 p.m., and was later spotted laughing with a member of Berry’s legal team. After court adjourned at 4:30 p.m., Berry was seen rubbing Hunt’s arm in the hallway before departing with her team.

The hearing is scheduled to resume Monday, when Berry’s daughter Nahla Aubry, 18, is expected to testify virtually. Her anticipated appearance comes after Martinez’s legal team objected to her participation, even as they reportedly sought to put Maceo on the stand.

Nahla previously submitted a court declaration stating she had never witnessed Berry abuse Maceo. The teenager’s testimony could prove pivotal as the court weighs Martinez’s allegations of an incident at Berry’s home on September 26, when he claims she choked their son during a confrontation.

Earlier in the week, Maceo himself spent upwards of four hours on the witness stand during closed-door proceedings. Martinez has argued the September incident reflects ongoing abusive behavior, and claimed Maceo reached out to him afterward asking to be picked up.

Berry’s attorneys have pushed back forcefully. Beck previously stated that Martinez’s claims were “entirely meritless and deliberately misleading,” stressing that Berry vigorously denies any wrongdoing. Her legal team has also alleged in court documents that Martinez has interfered with Maceo’s education and therapy, and accused him of involving the teenager in their dispute.

The current arrangement limits Berry’s time with Maceo after a judge granted Martinez a temporary domestic violence restraining order and his request for primary custody. Berry is seeking to have that order dismissed and to restore the previously established 50/50 physical custody agreement. She has also asked for sole legal custody to give her authority over Maceo’s education, therapy, and medical care.

The former couple’s history stretches back to 2013, when they married in a private ceremony and welcomed Maceo later that year. They separated in 2015 and seemingly finalized their divorce in 2023 after years of legal wrangling, with Berry ordered to pay Martinez $8,000 monthly in child support. That prior settlement has now collapsed into an acrimonious new front, with both sides trading accusations and their children drawn into the legal crossfire.

The hearing resumes Monday in Los Angeles.
