KJ Biermann’s attorney is pushing for the jailed teen to be released on bond, pointing to his academic record, football career and family ties as proof he is not a flight risk.
The 15-year-old son of Kim Zolciak, 48, and Kroy Biermann, 40, has been held at Atlanta’s Metro Regional Youth Detention Center since his Aug. 17 arrest on charges of aggravated sodomy and aggravated sexual battery. His lawyer filed a motion Wednesday in the Superior Court of Fulton County requesting a bond hearing, according to court documents obtained Thursday.
“The accused turned fifteen years old in May. He is a high school student in good standing who has demonstrated strong academic achievement and regularly participates in extracurricular and community-based activities,” the attorney wrote in the filing. “He is an accomplished football player who has received scholarship offers based upon his athletic ability.”
The filing emphasized Biermann’s deep roots in his community, noting he maintains relationships with both parents and has five siblings. He is also supported by what the attorney described as an “established community of extended family, friends, coaches, teachers, and others who remain actively involved in his life and continue to support him and his family during the pendency of these serious allegations.”
These connections, the attorney argued, are “not merely favorable attributes” but “ties that bind [KJ] to his home, his school, his family, and this community.” The filing claimed these relationships provide “structure, supervision, accountability, and compelling reasons for him to remain here and comply with every condition imposed by this Court.”
The attorney also revealed that Biermann voluntarily submitted to a polygraph examination as part of his defense. “The results of that test,” the filing stated, “showed no deception when answering the two relevant questions concerning the alleged conduct.”
The bond request comes as the teen remains in custody at the Metro Regional Youth Detention Center in Atlanta, where he has been held for over a month since his late-summer arrest. The facility houses juvenile offenders in the metro area as they await court proceedings.
The aggravated sodomy and aggravated sexual battery charges carry significant weight under Georgia law, with potential consequences that could reshape the trajectory of Biermann’s young life. The case has drawn attention due to his parents’ public profiles — Zolciak rose to fame on “The Real Housewives of Atlanta” before starring in her own spinoff, “Don’t Be Tardy,” which documented her family life with Biermann and their children.
