Prosecutors have filed an emergency motion seeking court-ordered forensic interviews of minor children in the felony case against KJ Biermann.
The 15-year-old son of reality star Kim Zolciak, 46, and former NFL player Kroy Biermann, 39, was indicted earlier this month on seven felony charges including aggravated child molestation, aggravated sodomy, aggravated sexual battery, false imprisonment and three counts of aggravated sexual battery against a child under 16. The alleged incident occurred in April in Alpharetta, Georgia.
In Thursday’s filing, prosecutors requested that forensic interviews of “minor children” be ordered, according to court documents. A forensic interview is defined as “a neutral, developmentally and culturally appropriate conversation with a child intended to elicit detailed information about a possible event(s) that the child may have experienced or witnessed,” per the Georgia Center for Child Advocacy.
KJ has been held at Atlanta’s Metro Regional Youth Detention Center since his August arrest. He was granted bond last week set at $200,000, though his release date has not been announced.
The conditions of his release are extensive. Once out, KJ will be subject to electronic monitoring and barred from any direct or indirect contact with the alleged victim, her family or associates. He cannot contact anyone aged 16 or under, must remain at his mother’s home, attend school virtually, abstain from social media and avoid all cellphone use.
The case involves allegations that extend back further than initially known. During the contentious Sept. 11 bond hearing, Deputy District Attorney Caitlin McGillicuddy revealed investigators previously found multiple videos on KJ’s phone depicting him having sex with a female family member under the age of 12 while using “predatory, derogatory” language toward the alleged victim on “multiple occasions.”
This prior matter was initially reported in 2023, and KJ has been under court supervision since October 2023 as a result.
KJ’s lawyer, Jason Sheffield, pushed back against the prosecutor’s characterization of the earlier case. “The characterizations made in court regarding the prior juvenile matter involving KJ Biermann grossly misrepresent both the facts and the ultimate resolution of that case,” he insisted.
Sheffield continued, “The matter arose from inappropriate, crude behavior involving two middle-schoolers. It did not result in an adjudication for statutory rape, sexual intercourse, or any comparable offense.”
“Any suggestion otherwise is inaccurate and creates a materially misleading impression of how the juvenile matter was ultimately resolved,” he added.
Sheffield also shared that his client expects to plead not guilty to all charges at his arraignment on Oct. 14.
The phone restrictions in KJ’s bond conditions carry additional context. Zolciak confiscated the teen’s phone more than one year before his detention, reportedly over an unknown “discovery” on the device.
The current charges stem from the April incident in Alpharetta that led to KJ’s August arrest and subsequent indictment. The case has drawn significant attention given the family’s public profile from “The Real Housewives of Atlanta” and “Don’t Be Tardy.”
The emergency motion for forensic interviews signals prosecutors are actively building their case as the October court date approaches. KJ remains in detention pending his release on bond.
KJ Biermann is scheduled to be arraigned on Oct. 14.
