KJ Biermann has filed a motion asking a Georgia judge to reconsider a prior ruling in his felony sexual battery and sodomy case.
Biermann, 15, submitted the “motion for reconsideration of the court’s October 5th” order on Oct. 14, according to court papers. The actual motion and order remain sealed from public view. A separate filing for a “request for certificate of immediate review of the court’s October 5th” order was also submitted under seal. The teen was not required to attend a hearing that took place on Oct. 14.

The filings come after Biermann — whose full name is Kroy Biermann Jr. — officially pleaded not guilty to all seven felony charges against him, waiving his formal arraignment. His attorney, Jason Sheffield, had requested the hearing date be transferred to Fulton County Juvenile Court.
Biermann was arrested on Aug. 17 and held for more than a month at Atlanta’s Metro Regional Youth Detention Center before being released in September on $200,000 bond. The charges include aggravated sexual battery, aggravated sodomy, aggravated child molestation, three counts of aggravated sexual battery against a child under 16, and false imprisonment.
The accusations stem from an April incident at a Life Time fitness center in Alpharetta, Georgia. A female classmate who described herself as Biermann’s girlfriend’s “best friend” told the Alpharetta Police Department that he forced himself on her and attempted “multiple times to have sexual intercourse with her by trying to pull down her pants.” She further claimed he forced her to perform oral sex before digitally penetrating her vagina, and that when she managed to get away, he “pulled up his pants and left.”

The teen was examined at a medical center, but authorities said no evidence of male DNA was found in her mouth or vagina. Biermann is the oldest son of “Real Housewives of Atlanta” alum Kim Zolciak and her ex-husband, former NFL linebacker Kroy Biermann.

Biermann’s next hearing in Fulton County Juvenile Court has not been publicly scheduled.
