The alleged victim in KJ Biermann’s sexual assault case told a Georgia judge she is terrified the teen will target her if released from custody.
The 15-year-old girl, described in court as the girlfriend’s “best friend” of the accused, submitted a written statement that was read aloud during a bond hearing Friday in Fulton County Superior Court by Deputy District Attorney Caitlin McGillicuddy. The girl wrote that she has been “living in fear” and has received threats that KJ would come after her if granted bond.
“No matter who these threats came from directly, I cannot just ignore them or assume that nothing will happen,” she wrote in her statement.
The girl’s fears extended beyond herself. “I am not only scared for myself anymore; I am scared for my family, too,” she continued. “Members of my family have received emails and phone calls because of this situation.”
She added, “The thought of him being released scares me more than I can put into words.”
The judge, who heard the victim’s plea alongside arguments from both prosecution and defense, said she will decide by Monday whether KJ will be released on bond. Until that ruling, he remains held at Atlanta’s Metro Regional Youth Detention Center, where he has been since his August arrest.
KJ, the son of “Real Housewives of Atlanta” alum Kim Zolciak, 46, and former NFL linebacker Kroy Biermann, 39, was arrested on Aug. 17 and charged with aggravated sodomy and aggravated sexual battery. He was officially indicted on seven total charges on Sept. 3.
His attorney, Jason Sheffield, had filed documents requesting the bond hearing, citing KJ’s age, academic record, football achievements and scholarship offers. “The accused turned 15 years old in May. He is a high school student in good standing who has demonstrated strong academic achievement and regularly participates in extracurricular and community-based activities,” Sheffield argued in the filing.
However, the hearing took a dramatic turn when prosecutors revealed that investigators had previously found videos on KJ’s cellphone allegedly depicting penetrative sex with a family member under the age of 12. McGillicuddy claimed there were “multiple encounters” on video and that they allegedly showed KJ using “predatory, derogatory” language toward that victim.
The prosecutor argued that because of this revelation, KJ’s alleged assault against his classmate “would now mark the second time he has been charged with an offense of a sexual nature of a very serious kind which involves female victims.” Sheffield declined to comment on the new allegation when pressed.
The classmate accused KJ of assaulting her on April 23 inside the Life Time Fitness center in Alpharetta, Georgia, according to court documents. She told officials that while in a co-ed sauna, KJ forced himself on her despite her saying no and attempted “multiple times to have sexual intercourse with her by trying to pull down her pants.” She further accused him of forcing oral sex and digitally penetrating her vagina. The girl said she did not report the alleged assault immediately but suffered a panic attack the next day at school when she ran into KJ’s girlfriend. She was later examined at North Fulton hospital on April 24, with a police report showing no evidence of male DNA in her mouth or vagina.
Following KJ’s arrest, Sheffield said that his client is “100% innocent.” Zolciak also slammed the allegations against her son in an Aug. 21 statement, calling them “reckless” and “deeply troubling.”
During Friday’s hearing, KJ was supported by his mother, who looked “stone-faced,” his “stressed” father, and his eldest sister, Brielle.
The judge is expected to issue her bond decision by Monday.
