KJ Biermann could face house arrest and GPS monitoring if granted bond after being indicted on multiple sexual assault charges.
The 15-year-old son of “Real Housewives of Atlanta” alum Kim Zolciak, 48, and former NFL player Kroy Biermann, 40, was formally indicted on charges including aggravated child molestation, aggravated sodomy, aggravated sexual battery, false imprisonment and three counts of aggravated sexual battery against a child under 16. The indictment stems from an alleged incident at a Life Time fitness center in Alpharetta, Georgia, on April 23.
Sexual assault case expert and former prosecutor Lindsay Richards, who is not involved in the teen’s case, said that KJ’s new normal would involve “close, close monitoring” if released.
“I think there’s a likelihood he’ll be released and he will have a lot of conditions of his release,” she said. “I think he’ll be on a GPS. He’ll probably be on house arrest, having to do school at home.”
Richards noted that KJ might also be required to enroll in educational courses and therapy sessions before trial. She called the charges “unbelievably serious” and said a conviction could bring decades of prison time. The fact that he remains behind bars, she added, could indicate “a strong case against him.”
“Not releasing him into the custody of his parents with electronic monitoring of some kind, that surprises me for this young of a kid,” Richards said.
KJ was arrested on Aug. 17 after a female classmate alleged he sexually assaulted her in a co-ed sauna at the fitness center. He is accused of forcing the classmate to engage in numerous sexual acts without her consent.
KJ’s attorney, Jason Sheffield, has maintained his client’s innocence. Sheffield said that KJ is “100% innocent” and claimed to have evidence to prove it. Sheffield also disclosed that KJ voluntarily took a polygraph test, with results showing “no deception when answering the two relevant questions concerning the alleged conduct.”
Zolciak defended her son through her representative on Aug. 21.
“The allegations being made against my son are nothing short of reckless and deeply troubling,” she said.
“He categorically denies ever being involved with this woman or engaging in the conduct she has alleged,” she added.
KJ’s legal team has pleaded for his release from Atlanta’s Metro Regional Youth Detention Center, where he is currently being held. His attorneys have cited his football and academic accomplishments, as well as his strong ties to the community and his family, in their arguments for bond.
Richards said she expects prosecutors will attempt to have KJ tried as an adult given the severity of the charges.
The case has drawn significant attention due to Zolciak’s reality television fame. Zolciak and Biermann, who are currently estranged, share four children together, while Zolciak has two daughters from previous relationships.
The alleged assault occurred when KJ and the female classmate were both at the Life Time fitness center in April. According to the allegations, the incident took place in the co-ed sauna at the Alpharetta location.
KJ remains held at the Metro Regional Youth Detention Center as his case proceeds through the legal system.
