Halle Berry’s Ex Olivier Martinez Hopes Their Son Will ‘Forgive’ Her After Bitter Custody Spat

Olivier Martinez said he wants his son with Halle Berry to “forgive” the actress after a judge ruled on their custody fight.

Martinez, 60, spoke to “Extra” outside court on Thursday after Judge Shelley Kaufman dissolved the temporary restraining order Berry’s ex-husband had obtained against her. The French actor retained physical custody of Maceo, 13, while the former couple will continue to share legal custody. Their arrangement faces further review at a hearing next month.

“I don’t want my son to hate his mom. I want him to love her,” Martinez told the outlet. “I want him to forgive her, and I want them to reconciliate [sic] in some sort at one point.”

He added that he “truly hopes” Berry and Maceo “will be able to have a better relationship in the future.” The remarks came moments after Kaufman also dismissed Martinez’s request for a domestic violence restraining order against his ex-wife, a decision Berry’s camp counted as a significant victory.

“We are extremely pleased that the Court has dissolved the TRO,” Berry’s attorney, Marina Beck, told reporters after the hearing. “As we move forward, Halle is determined to continue to focus on the well-being and best interests of her family.”

A source close to the Oscar winner called the ruling “a huge win for Halle.”

The legal fight exploded earlier this month when Martinez accused Berry of physically abusing Maceo, alleging she had jumped on and choked the teenager. He filed for emergency sole custody and a temporary restraining order, which was granted and left Berry with only court-ordered visitation. Berry, 60, has forcefully denied the claims, with Beck previously calling Martinez’s filing “entirely meritless and deliberately misleading.”

Berry fired back with allegations that Martinez had manipulated Maceo into becoming “angry and combative” toward her. She asked the court to restore their 50/50 custody split and sought sole legal custody, arguing Martinez had repeatedly interfered with their son’s needs.

The case produced dramatic courtroom moments over several days. On Oct. 19, Maceo testified for nearly four hours in what witnesses described as an “icy” atmosphere. The next day, Martinez stormed out of the courtroom appearing agitated and distressed, with observers saying he could be heard using profanity before returning roughly five minutes later for closed testimony.

During his Oct. 22 testimony, Martinez stood by his abuse allegations against Berry even when confronted with a 2024 declaration he had signed under penalty of perjury stating there had been no history of domestic violence between them.

Berry’s support system was visible throughout the proceedings. Her daughter, Nahla Aubry, 18, and her fiancé, Van Hunt, 56, both took the stand ahead of closing arguments earlier this week.

The temporary restraining order’s dissolution marks a shift in the case’s trajectory, though physical custody remains with Martinez for now. Legal custody stays shared, and the scheduled hearing next month will address whether that arrangement changes.

Berry and Martinez married in 2013 and separated two years later, finalizing their divorce in 2016. The current battle represents their most public and acrimonious conflict over co-parenting since then.
